My daughter is 6 months pregnant and married to a guy in NC. They got married in MA 2 years ago. She just found out he was cheating on her. If she comes back to MA before having the baby to live permanently will she have to go back to NC to get the divorce or can she get it in MA? Also what state has better child custody laws and rights for a women MA or NC?What are the laws in NC pertaining to marriage and children?
Every state, with the exception of Texas, leans toward mothers getting custody. I teach fathers how to fight for custody. Texas is different as they use juries, which are nearly always women, who are more likely to award to a father. Whether her claim is true or not, she will need to file in NC.
